SMS Communications Terms
These terms govern text messages sent by Proficient Plus LLC and applicable Proficient Plus products, including SanctuaryHub, where Proficient Plus is the sender.
About these SMS Terms
These SMS Communications Terms (“SMS Terms”) apply when you opt in to receive text messages from Proficient Plus LLC (“Proficient Plus,” “we,” “us,” or “our”) or from a Proficient Plus product where Proficient Plus is the sender.
These SMS Terms supplement our:
- Privacy Policy;
- Website Terms of Service; and
- any applicable product-specific terms or notices.
If a separate agreement applies to a specific product or service, that agreement continues to govern its subject matter.
These SMS Terms do not automatically govern text messages sent by a SanctuaryHub tenant, such as a church or ministry, to its own members or recipients. Those communications may be governed by that tenant’s own notices, consent process, and messaging program terms.
SMS program purpose
Proficient Plus may use SMS to communicate with customers, prospective customers, tenant administrators, authorized users, service recipients, and other individuals who have agreed to receive applicable text messages.
Depending on the context and the consent provided, messages may include:
- account notifications;
- onboarding information;
- application notifications;
- service-related updates;
- support communications;
- administrative notices;
- security or operational alerts;
- requested reminders;
- appointment or consultation information;
- updates related to Proficient Plus services;
- communications relating to Proficient Plus products, including SanctuaryHub; and
- other messages described when you opt in.
We do not use your enrollment in one SMS program as blanket consent for unrelated SMS programs.
Consent to receive SMS
You will receive applicable SMS communications only where Proficient Plus has a lawful basis to send them and, where required, after you have provided appropriate consent.
Consent may be provided through methods such as an online form, a product or account setting, a registration or onboarding workflow, a written form, an inbound text message, another documented consent process, or another method permitted by applicable law and messaging requirements.
Where SMS consent is collected through a form, the consent should be separate from unrelated consent and should clearly identify Proficient Plus LLC as the sender, or the applicable Proficient Plus product; the types of messages you may receive; that message frequency may vary; that message and data rates may apply; how to opt out; how to obtain help; and links to applicable Privacy and SMS Terms.
Consent to receive SMS messages is voluntary. Unless specifically disclosed for an optional feature that depends on SMS functionality, consent to receive SMS messages is not a condition of purchasing or using a Proficient Plus product or service. You can opt in through our SMS Opt-In page.
Message frequency
Message frequency varies depending on the services you use, the notifications you request, the nature of your relationship with Proficient Plus, account or product activity, support interactions, and other communications you have chosen to receive.
Some recipients may receive only occasional messages, while others may receive messages more frequently based on their use of Proficient Plus services or products.
Message and data rates
Message and data rates may apply. Your mobile carrier may charge you for sending or receiving SMS or MMS messages according to your wireless plan. Proficient Plus is not responsible for charges imposed by your mobile carrier.
Opting out
You may opt out of applicable SMS communications at any time by replying STOP to a Proficient Plus SMS message. Where supported, similar carrier-recognized opt-out keywords may also be honored.
After a valid opt-out request, we may send a final confirmation message informing you that you have been unsubscribed. After that confirmation, we will not send additional messages through the applicable SMS program unless you later opt back in, the law permits a limited communication necessary to process your request, or another separate SMS program applies for which you have independently provided consent.
We may retain limited records of your opt-out request and mobile number as necessary to maintain suppression controls and honor your communication preference.
Re-enrollment
If you previously opted out and later wish to receive SMS communications again, you must affirmatively re-enroll. Depending on the applicable messaging program, re-enrollment may be available through a new opt-in form, an account or product communication setting, replying START where supported, or another method provided by Proficient Plus.
A prior opt-out will not be treated as withdrawn unless a valid new opt-in is recorded.
Help
For assistance with Proficient Plus SMS communications, you may reply HELP where supported. You may also contact Proficient Plus at info@proficient-plus.com or through the Contact page.
Supported carriers and devices
SMS communications depend on telecommunications networks, mobile carriers, devices, and other third-party systems that are outside Proficient Plus’s direct control. SMS service may not be available on every mobile carrier, in every country or region, on every device, at all times, or where network or carrier restrictions apply.
Delivery
Proficient Plus does not guarantee that every SMS message will be delivered immediately or successfully. Messages may be delayed, blocked, filtered, duplicated, or undelivered because of circumstances such as carrier filtering, network outages, invalid or inactive numbers, device settings, roaming restrictions, recipient blocking, regulatory controls, messaging-provider interruptions, or other technical conditions outside our reasonable control.
Wireless carriers are not liable for delayed or undelivered messages.
Your responsibilities
When enrolling in Proficient Plus SMS communications, you are responsible for providing a mobile number that you are authorized to use, keeping your mobile number current where applicable, not enrolling another person’s number without authorization, reviewing the applicable messaging disclosures, and maintaining control of the device or account associated with your mobile number.
If your mobile number changes ownership or you no longer control the number, you should update your information or opt out as soon as reasonably possible.
Privacy and mobile information
Proficient Plus handles personal information associated with SMS communications in accordance with our Privacy Policy. This may include mobile telephone number, SMS communication preferences, opt-in records, opt-out records, message delivery information, inbound replies, support requests, message history, and records reasonably necessary to administer the SMS program.
Proficient Plus does not sell or share mobile telephone information, SMS opt-in information, or SMS consent information with third parties or affiliates for their own promotional or marketing purposes.
We may share information with telecommunications carriers, messaging platform providers, infrastructure providers, and other service providers acting on our behalf only as reasonably necessary to provide, secure, support, or administer SMS communications. For additional information, see our Privacy Policy.
Service providers
Proficient Plus may use third-party telecommunications and messaging service providers to deliver SMS communications. These providers may process information such as mobile numbers, message content, timestamps, message status, delivery events, inbound messages, and opt-out requests as necessary to provide messaging services.
Use of these providers does not authorize them to use SMS opt-in or consent information for their own unrelated promotional or marketing purposes.
Proficient Plus products, including SanctuaryHub
Proficient Plus may use its SMS program to send communications relating to products it owns or operates, including SanctuaryHub. Examples may include account activation, onboarding, tenant administrator notifications, service status information, application notifications, support communications, security-related notifications, and other product-related messages for which the recipient has consented.
These Proficient Plus-originated messages are separate from tenant-originated communications. For example, a church using SanctuaryHub may operate its own messaging program for communications to its members. In that case, the church may be the sender, may use its own verified sending number, may be responsible for its own recipient consent and messaging practices, and additional SanctuaryHub and tenant-specific terms may apply.
Proficient Plus’s corporate SMS number should not be assumed to represent or replace a tenant organization’s independent messaging identity. You can learn more about SanctuaryHub at sanctuaryhub.io.
Marketing communications
Proficient Plus may send promotional or marketing SMS only where permitted by applicable law and where any required consent has been obtained. Consent to receive transactional, service-related, support, administrative, or account communications does not automatically constitute consent to receive unrelated promotional or marketing messages.
Where Proficient Plus offers marketing SMS, the applicable opt-in process may include additional or separate disclosures and consent requirements. You may opt out of applicable marketing SMS at any time using the methods described in these SMS Terms.
Security and abuse prevention
Proficient Plus may use reasonable technical and organizational measures to protect its SMS program and prevent spam, fraud, unauthorized use, abusive messaging, impersonation, message manipulation, or other unlawful or harmful activity. We may restrict or suspend use of SMS functionality where reasonably necessary to protect users, carriers, providers, Proficient Plus systems, or third parties.
Changes to the SMS program
Proficient Plus may change, suspend, or discontinue an SMS program or particular SMS feature where reasonably necessary. We may also update message types, delivery providers, sending numbers, short codes or toll-free numbers, product-specific notification functionality, or messaging processes. Where required, we will provide appropriate notice of material changes.
Changes to these SMS Terms
We may update these SMS Terms from time to time to reflect changes in our messaging practices, products or services, telecommunications requirements, carrier requirements, legal or regulatory obligations, or our business operations. When we update these SMS Terms, we will revise the Last updated date shown above. Where required by law, we may provide additional notice.
Relationship to other terms
These SMS Terms supplement the Proficient Plus Privacy Policy, Website Terms of Service, and applicable product-specific terms. If a separate signed agreement applies to a Proficient Plus product or service, that agreement governs matters within its scope. Nothing in these SMS Terms overrides rights that cannot lawfully be waived.
